GSI’s environmental experts assist legal teams in apportioning past and/or future potential environmental liabilities, such as natural resource and environmental remediation damages, among multiple parties. Our experts develop defensible allocation methodologies and approaches that consider allocation criteria such as historical and current operations and use of the property, the nature, timing, and causation of the environmental release, and the associated remediation requirements.
GSI evaluated environmental conditions associated with oilfield operations in the Oriente region in Ecuador, investigating over 74 oilfield facilities in a 4,000-square kilometer Concession area. Assessed the cause and timing of identified impacts to soil, groundwater, and other environmental resources. Delineated the area and volume of affected soil and groundwater and developed preliminary engineering designs and cost estimates for appropriate remedial actions. Utilized estimates of affected soil and groundwater and of the cause and timing of the releases to allocate environmental liabilities to multiple operators.
GSI evaluated past and likely future response costs associated with the Richardson Flat Tailings Superfund Site, and appropriate allocation among responsible parties. Investigated historical mining and milling operations in the Park City, Utah area, and evaluated tailings impacts, migration pathways, and transport mechanisms. Assessed whether an allocation of costs based on relative volumes of tailings disposed at Richardson Flat was feasible, appropriate, and consistent with accepted allocation practice based on site-specific conditions, the responsibilities of the parties involved in mining operations, and cost factors established by prior court cases.
